1. Overview
This website is operated by PEAR & SIMPLE, LLC, doing business as Pear & Simple. Throughout these Terms of Service, “Pear & Simple,” “we,” “us,” and “our” refer to PEAR & SIMPLE, LLC. We offer this website, including all information, tools, products, and services available through it, conditioned upon your acceptance of these Terms of Service and any policies referenced here.
By visiting pearandsimple.com, purchasing from us, creating an account, or otherwise using our website or services, you agree to these Terms of Service. If you do not agree, please do not use the website or services.
Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.
2. Eligibility and account information
You must be at least the age of majority in your state of residence, or use this website with the involvement and permission of a parent or legal guardian.
When you place an order or create an account, you agree to provide current, complete, and accurate information. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs through your account.
We may refuse service, close an account, or cancel an order when reasonably necessary to protect PEAR & SIMPLE, LLC, our customers, or the integrity of our services, subject to applicable law.
3. Products and availability
We make reasonable efforts to display product descriptions, colors, images, prices, and availability accurately. Screen settings, photography, supplier information, and other factors may cause actual products to differ slightly from their online presentation.
Many of our products are seasonal, limited-run, handmade, or available in small quantities. We do not guarantee that any product will remain available. We may limit quantities, discontinue products, or correct product information at any time.
Products marked “In Store Only” are displayed for informational purposes and are not available for online checkout unless expressly stated otherwise.
4. Orders and acceptance
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not constitute final acceptance. We may decline or cancel an order because of inventory errors, pricing errors, suspected fraud, payment problems, shipping restrictions, or other reasonable business concerns.
If we cancel an order after payment has been processed, we will issue the appropriate refund to the original payment method.
We may limit or cancel quantities purchased per person, household, account, payment method, billing address, shipping address, or order.
5. Pricing, payment, and taxes
Prices are shown in U.S. dollars unless stated otherwise. Prices, promotions, and product availability may differ between our website and physical store. We may change prices or promotions at any time before an order is accepted.
You agree to provide valid payment information and authorize us and our payment processors to charge the total amount shown at checkout, including applicable taxes, shipping charges, and other disclosed fees.
6. Shipping, pickup, and delivery

Delivery dates are estimates and are not guaranteed. Delays caused by carriers, weather, incorrect addresses, or events outside our reasonable control may occur.
Customers are responsible for providing a complete and accurate shipping address. Please contact us promptly if an address needs to be corrected; we cannot guarantee changes after an order enters processing.
For store pickup orders, the person collecting the order may be asked to provide the order confirmation and identification. Pickup availability and timing are subject to store operations and inventory confirmation.
If we cannot ship an online order within the time stated at checkout or on our website—or within 30 days when no shipping time is stated—we will notify you of the delay and provide a revised shipping estimate. You may agree to the delay or cancel the affected order for a prompt full refund to the original payment method, as required by applicable law.
7. Returns, exchanges, final-sale items, and store credit
Returns, exchanges, final-sale exclusions, damaged items, and store credit are governed by our Return and Refund Policy at https://pearandsimple.com/policies/refund-policy. The Return and Refund Policy is incorporated into these Terms by reference.
Unless required by law or stated in the Return and Refund Policy, store credit is not redeemable for cash and may not be transferred to another person or account.
8. Personalization and customer-provided details
For products that offer personalization, you are responsible for reviewing names, dates, spelling, capitalization, and other submitted details before placing the order. Please contact us as soon as possible if you discover an error. We cannot guarantee that personalization can be changed after work has begun.
We may refuse personalization that is unlawful, infringing, threatening, hateful, obscene, or otherwise inappropriate. Rights and remedies for personalized merchandise remain subject to applicable law and our Return and Refund Policy.
9. Gift cards, discounts, and promotions
Gift cards, discount codes, store credit, and promotional offers are subject to any additional terms presented with them. Unless expressly stated otherwise, promotions cannot be combined, have no cash value, and may be modified or ended at any time before an eligible order is placed.
We may cancel or withhold a discount or promotion when we reasonably determine that it was used fraudulently, contrary to its stated terms, or because of a technical error.
10. Reviews, messages, and other submissions
If you submit a review, photograph, comment, suggestion, or other content, you confirm that you have the right to provide it and that it does not violate another person’s rights or applicable law.
You grant PEAR & SIMPLE, LLC a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display content that you voluntarily submit in connection with our business and services. This license does not apply to private customer-service communications except as needed to address your request, comply with law, or protect legal rights.
We may remove public submissions that are unlawful, abusive, misleading, infringing, or unrelated to the relevant product or service.

The website and its original text, graphics, logos, photography, design, and other content are owned by or licensed to PEAR & SIMPLE, LLC and are protected by applicable intellectual-property laws. You may use the website for personal, noncommercial shopping purposes only.

Product names, images, trademarks, and other materials belonging to our vendors remain the property of their respective owners.

To the extent permitted by law, PEAR & SIMPLE, LLC is not responsible for losses that were not reasonably foreseeable when an order was accepted, or for losses caused by misuse of the website, unauthorized account access resulting from a customer’s failure to safeguard credentials, or events outside our reasonable control. Rights and remedies relating to a product or order remain subject to applicable law and our published store policies.
16. Suspension and termination
We may suspend or terminate access to the website or services when we reasonably believe these Terms have been violated or when necessary to protect customers, PEAR & SIMPLE, LLC, or third parties. Provisions that by their nature should survive termination will remain in effect.
17. Severability and waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
18. Entire agreement

19. Governing law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Nothing in this section limits consumer-protection rights that apply under the laws of a customer’s state or other jurisdiction.

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Changes apply prospectively unless otherwise required by law.
